BOOKING TERMS AND CONDITIONS

Please read these terms before booking. They apply to direct bookings with Brathay Cottages. Your booking confirmation, property listing and house rules also form part of the agreement.

Effective from 20 August 2026. The version accepted when your booking is confirmed will apply to that booking.

1. WHO YOU ARE BOOKING WITH

Brathay Cottages is a trading name of JRG Hospitality Limited, registered in England and Wales under company number 13180143. Our registered office is Diamond Lodge, Lake Road, Ambleside, Cumbria LA22 0DN. Our trading address and contact details appear at the end of these terms.

In these terms, “we”, “us” and “our” mean JRG Hospitality Limited trading as Brathay Cottages; “you” means the lead guest; and “Property” means the accommodation in your booking confirmation. Unless the confirmation names another supplier, your booking contract is with us, even where the Property is owned by someone else.

The lead guest must be at least 18, have authority to book for everyone in the party and ensure that all guests and visitors follow these terms. A booking is confirmed only when we send written confirmation. Please check it promptly and tell us about any error. Property-specific terms shown during booking take priority over these general terms if they conflict.

2. PRICE AND PAYMENT

The total price, compulsory charges, optional extras and any security deposit will be shown before booking or in your confirmation. The confirmation will state how much is due and when. If no instalment plan is shown, the full amount is due when you book.

If payment is overdue, we will contact you and give you a reasonable opportunity to pay. If it remains unpaid, we may cancel the booking and apply clause 4. An obvious pricing or availability error does not bind either party; if one is found, we will offer you the correct booking or a full refund.

3. CHANGING YOUR BOOKING

Contact us as soon as possible if you want to change the dates, Property, lead guest or party size. Changes depend on availability and are effective only when confirmed in writing. Before agreeing a change, we will tell you about any price difference or reasonable direct administration cost. If we cannot agree the change and you cancel, clause 4 applies.

4. CANCELLATION BY YOU

To cancel, email info@brathaycottages.co.uk with your booking reference, Property and arrival date. Cancellation takes effect when we receive your clear written notice.

If notice is received 30 days or more before arrival: 80% of the total booking price will be refunded.

If notice is received less than 30 days before arrival: no automatic refund is due under the published policy.

We will take reasonable steps to re-let cancelled dates. If we do, we will refund any amount that would otherwise leave us recovering more than our reasonable direct loss, after allowing for any refund already made, any price reduction needed to re-let, non-recoverable third-party costs and reasonable administration costs. The refund cannot exceed what you paid.

The statutory 14-day cooling-off period does not normally apply to accommodation booked for specific dates. We strongly recommend suitable travel insurance. Nothing in this clause limits a refund required by law.

5. CHANGES OR CANCELLATION BY US

If we cannot provide the booked Property or must make a significant change, we will tell you promptly and offer a reasonably comparable alternative where available. You may accept it or cancel for a refund of the accommodation we cannot provide. If the alternative is cheaper, we will refund the difference.

We may end a booking for a serious breach, including continued non-payment, dangerous or unlawful behaviour, serious nuisance, deliberate or reckless damage, an unauthorised party or material excess occupancy. We will act reasonably, and any amount retained or claimed will be limited to our rights and reasonable direct loss.

6. ARRIVAL, DEPARTURE AND OCCUPANCY

Unless your confirmation says otherwise, check-in is from 4:00 pm and check-out is by 10:00 am. Only booked guests may stay overnight and the stated maximum occupancy must not be exceeded. You may not transfer or resell the booking without our written agreement.

Do not enter early or leave late without approval. You must reimburse reasonable direct costs caused by an unauthorised early arrival or late departure. You are also responsible for the reasonable replacement or security cost of lost or unreturned keys, permits and access devices.

7. USING THE PROPERTY

Use the Property responsibly, follow the listing, house rules and safety instructions, and consider neighbours. Unless we agree otherwise in writing, you must not smoke or vape inside; hold a party or event; cause excessive noise; use the Property as business premises or for unlawful, dangerous or customer-facing commercial activity; use fireworks, lanterns, candles or other naked flames; interfere with alarms or utilities; or charge an electric vehicle except from an approved charger.

You must supervise children and vulnerable guests, keep exits clear and follow instructions for fires, balconies, gardens, barbecues, hot tubs and other facilities.

8. PETS AND ASSISTANCE DOGS

Pets are permitted only where the listing allows them and must be declared before booking. Follow any limits or charges shown. Unless the property rules say otherwise, pets must be controlled, kept off beds and furniture, not left alone, and must not cause nuisance, fouling, damage or exceptional cleaning.

Assistance dogs are not treated as pets. Contact us so we can discuss reasonable adjustments and any relevant access or safety considerations.

9. DAMAGE AND EXTRA CLEANING

Report existing damage or cleanliness problems promptly after arrival, and tell us immediately about any damage or accident during your stay. You are responsible for loss, damage or exceptional cleaning caused by you, your guests, visitors or animals, except for fair wear and tear or matters that were not your fault.

We will explain any claim and provide reasonable supporting evidence. If a security deposit or card authorisation applies, it will be disclosed before booking or in your confirmation and used only for properly evidenced sums due. Any balance will be returned promptly.

10. FACILITIES, ACCESS AND BELONGINGS

Facilities vary, so ask before booking if parking, accessibility, internet performance or another feature is essential. Temporary interruption to Wi-Fi, utilities or equipment is not automatically a breach where it is outside our control and we take reasonable steps to investigate.

We, the owner or a contractor may enter at a reasonable time, and normally after notice, to inspect, maintain or repair the Property. We may enter without notice in an emergency or to prevent serious harm or damage.

You remain responsible for your belongings and vehicles unless loss or damage is caused by our breach or negligence. We may keep ordinary lost property for 28 days and charge reasonable return costs; perishable, dangerous, unhygienic or low-value items may be disposed of sooner.

11. PROBLEMS AND COMPLAINTS

Tell us promptly if something is wrong and give us a reasonable opportunity to investigate and put it right during your stay. Use the emergency contact supplied with your arrival information for urgent safety or property issues.

If the matter remains unresolved, email info@brathaycottages.co.uk with your booking reference and supporting information, ideally within 14 days after departure. This helps us investigate and does not remove any legal right.

12. OUR RESPONSIBILITY TO YOU

We will provide our services with reasonable care and skill. We are responsible for foreseeable loss caused by our breach or negligence, but not for loss caused by you, not reasonably foreseeable when the contract was made, or reasonably avoidable by you.

We do not exclude liability where doing so would be unlawful, including for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or rights that cannot legally be excluded. The accommodation is supplied for private use, so we are not responsible for business losses unless the law says otherwise.

13. EVENTS OUTSIDE REASONABLE CONTROL

Severe weather, flood, fire, epidemic, utility failure, transport disruption, government action, emergency repairs and similar unavoidable events may affect a stay. We will take reasonable steps to reduce the effect. If we cannot provide the contracted accommodation, we will offer an appropriate alternative or refund the accommodation not provided, in accordance with your legal rights.

14. PRIVACY AND OTHER LEGAL TERMS

We use personal information as described in our Privacy Policy and may contact the lead guest using the details supplied. Payment information may be handled by our payment and booking-system providers; do not send card details by ordinary email.

If part of these terms is unenforceable, the rest remains effective. A delay in enforcing a right is not a waiver. An identified property owner may enforce terms intended to protect the Property; otherwise, no third party may enforce this contract under the Contracts (Rights of Third Parties) Act 1999.

These terms and your booking are governed by the law of England and Wales. The courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts and retain any mandatory consumer protections that apply there.
